Amez Freelance – Terms and Conditions

These Terms and Conditions ("Terms") govern your use of all services offered by Amez Freelance, a freelancing platform operating globally. By registering, browsing, or engaging in services on Amez Freelance, you agree to be bound by these Terms in full. Please read them carefully before using the platform.

1. Definitions

1.1 "Amez Freelance" refers to the online freelancing marketplace provided under the domain https://amezfreelance.com and associated services.

1.2 "User" refers to any individual or entity using Amez Freelance, including Buyers and Freelancers.

1.3 "Buyer" refers to any User who purchases freelance services through the platform.

1.4 "Freelancer" refers to any User who offers freelance services ("Gigs") on the platform.

1.5 "Services" or "Gigs" refer to freelance work provided by Freelancers to Buyers.

1.6 "Order" refers to a formal request made by a Buyer for Services offered by a Freelancer through the platform.

2. Eligibility

2.1 You must be at least 18 years old to register and use Amez Freelance.

2.2 By using Amez Freelance, you confirm that you have the legal authority to enter binding agreements in your jurisdiction.

2.3 Accounts may not be transferred, sold, or shared without express written consent from Amez Freelance.

3. Account Registration

3.1 Users must create an account to access full platform features.

3.2 You agree to provide accurate, current, and complete information when creating your account.

3.3 Amez Freelance reserves the right to suspend or terminate accounts that provide false or misleading information.

4. User Conduct

4.1 Users agree to use Amez Freelance only for lawful purposes and in compliance with these Terms.

4.2 Harassment, discrimination, fraud, spamming, and unauthorized use of content are strictly prohibited.

4.3 Amez Freelance may suspend or permanently ban Users who violate these rules.

5. Services and Transactions

5.1 Freelancers may create and publish Gigs offering their Services.

5.2 Buyers may purchase Gigs by placing Orders through the platform.

5.3 Payments must be processed exclusively through Amez Freelance’s secure system. Direct payments outside the platform are prohibited.

5.4 Amez Freelance charges a service fee on all transactions. The applicable fee will be disclosed at the time of transaction.

6. Payment and Withdrawal

6.1 Buyers pay in advance when placing an Order.

6.2 Freelancers will receive payment once an Order is marked as "Completed" by the Buyer, subject to a clearance period.

6.3 Withdrawals must be made through approved payout methods. Amez Freelance may impose minimum withdrawal limits and processing times.

7. Disputes and Cancellations

7.1 Buyers and Freelancers are encouraged to resolve disputes through direct communication.

7.2 If resolution fails, Amez Freelance may intervene and make a binding decision.

7.3 Orders may be canceled in cases of fraud, non-delivery, or violation of these Terms.

8. Intellectual Property

8.1 Unless otherwise agreed, the full intellectual property rights of delivered work transfer to the Buyer once payment is made.

8.2 Freelancers retain rights to any pre-existing materials, templates, or tools used to complete the work.

8.3 Users may not use, resell, or distribute any content from Amez Freelance without explicit permission.

9. Limitation of Liability

9.1 Amez Freelance provides the platform "as is" and makes no guarantees about the quality, safety, or legality of Services.

9.2 Amez Freelance is not responsible for disputes, delays, or damages resulting from transactions between Users.

9.3 To the maximum extent permitted by law, Amez Freelance’s liability shall be limited to the fees retained from the disputed transaction.

10. Amendments

10.1 Amez Freelance may update or modify these Terms at any time.

10.2 Users will be notified of major changes, and continued use of the platform after changes take effect constitutes acceptance.

11. Governing Law

11.1 These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to conflict of law principles.

11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
